“Non fatemi vedere i vostri palazzi ma le vostre carceri, poiché è da esse che si misura il grado di civiltà di una Nazione”

Abstract

Questa tesi si propone di esplorare la rieducazione in ambito carcerario, intesa come reinserimento sociale del detenuto e recupero delle sue capacità morali e civiche, rappresenta uno degli scopi principali della pena in molte legislazioni, ma quanto le carceri europee sono effettivamente in grado di raggiungere questo obiettivo? Le strutture sovraffollate, le condizioni di vita disumane, la mancanza di programmi riabilitativi adeguati e le disparità tra i vari sistemi giuridici pongono seri interrogativi sulla reale efficacia delle misure rieducative. In particolare, l'analisi si concentrerà su diversi modelli penitenziari europei, Spagna, Francia, Norvegia, Germania e Olanda, esaminando il contrasto tra sistemi che privilegiano l'integrazione e la riabilitazione (come quello norvegese o olandese) e quelli più retributivi, dove la punizione sembra prevalere sugli altri scopi. La domanda che guida questa ricerca è: la rieducazione è una realtà nelle carceri europee o si tratta di una mera utopia, destinata a essere inattuata a causa delle problematiche strutturali e sociali che affliggono i sistemi penitenziari?

This thesis aims to explore rehabilitation within the prison system, understood as the social reintegration of prisoners and the recovery of their moral and civic capacities. It represents one of the main objectives of punishment in many legal systems, but to what extent are European prisons actually able to achieve this goal? Overcrowded facilities, inhumane living conditions, the lack of adequate rehabilitation programs, and disparities between different legal systems raise serious questions about the real effectiveness of rehabilitative measures. In particular, the analysis will focus on different European prison models—Spain, France, Norway, Germany, and the Netherlands—examining the contrast between systems that prioritize integration and rehabilitation (such as those in Norway or the Netherlands) and those that are more retributive, where punishment seems to outweigh other goals. The question guiding this research is: Is rehabilitation a reality in European prisons, or is it merely an unattainable utopia, hindered by the structural and social problems plaguing prison systems?
