AFFRONTARE LE OMBRE NELL'AMBITO FAMILIARE: IL RUOLO DELL'ASSISTENTE SOCIALE NEL CONTRASTO ALLA VIOLENZA DOMESTICA

Abstract

La violenza domestica rappresenta una problematica sociale di rilevanza globale, con profonde implicazioni sul benessere delle vittime e sulla società nel suo complesso. Questa tesi analizza il fenomeno andando ad esplorandone le dinamiche, il quadro normativo e il ruolo centrale del servizio sociale. Nel primo capitolo si fornisce una definizione dettagliata della violenza domestica, esaminandone le cause, le diverse tipologie di vittime e l'impatto psicologico e sociale. Viene definito il ciclo della violenza, il quale aiuta a comprendere la natura ciclica di questi abusi, nonché l'importanza di riconoscere e segnalare i segnali di allarme. Il secondo capitolo approfondisce il contesto giuridico, partendo da normative internazionali, europee e nazionali. Tra queste, vengono esaminate la Convenzione di Istanbul, la Direttiva 2011/99/UE e la Direttiva 2012/29/UE, fino alla recente Direttiva 2024/1385. A livello italiano, l'analisi include strumenti legislativi come la Legge 154/2001, il "Codice Rosso" e la Riforma Cartabia, con un focus particolare sul panorama normativo della Regione Piemonte. Il terzo capitolo è dedicato al ruolo dell’assistente sociale nelle situazioni di violenza domestica. Si evidenziano le fasi dell'intervento, dalla valutazione del rischio al supporto alle vittime, sottolineando l'importanza del lavoro in rete con altri servizi. Una parte significativa è rivolta anche agli interventi con gli autori di violenza, analizzando strategie di comunicazione e gestione dei colloqui. La tesi si conclude con una riflessione sulla necessità di approcci integrati e preventivi per contrastare la violenza domestica, promuovendo la protezione delle vittime e il reinserimento degli autori nella società.

Domestic violence represents a global social issue with profound implications for the well-being of victims and society as a whole. This thesis analyzes the phenomenon by exploring its dynamics, the legal framework, and the central role of social work. The first chapter provides a detailed definition of domestic violence, examining its causes, the various types of victims, and the psychological and social impact. The cycle of violence is defined, which helps to understand the recurring nature of such abuses, as well as the importance of recognizing and reporting warning signs. The second chapter delves into the legal context, starting with international, European, and national regulations. Among these, the Istanbul Convention, Directive 2011/99/EU, and Directive 2012/29/EU are examined, culminating with the recent Directive 2024/1385. At the Italian level, the analysis includes legislative tools such as Law 154/2001, the "Codice Rosso," and the Cartabia Reform, with a particular focus on the regulatory framework of the Piedmont Region. The third chapter is dedicated to the role of social workers in situations of domestic violence. It highlights the phases of intervention, from risk assessment to victim support, emphasizing the importance of networking with other services. A significant part also addresses interventions with perpetrators of violence, analyzing communication strategies and the management of interviews. The thesis concludes with a reflection on the need for integrated and preventive approaches to counter domestic violence, promoting the protection of victims and the reintegration of perpetrators into society.
