Diritti e tutele dei lavoratori nell'era del progresso tecnologico

Abstract

La tecnologia odierna porta con sè delle problematiche che si riflettono anche sul mondo del lavoro. L’utilizzo di social network, big data e più in generale di nuove tecnologie, compromettono la figura del lavoratore che, in quanto parte debole del rapporto di lavoro, necessita di tutele crescenti nell'onda del progresso tecnologico. Non solo lo Statuto dei lavoratori, ma anche la normativa sulla privacy, riconoscono diritti ai lavoratori, quali persone fisiche, garantendo principi e regole fondamentali nel rapporto di lavoro: dall’analisi del divieto di indagini, alla disciplina del potere di controllo a distanza, si intreccia la materia della riservatezza, nonché il relativo apparato sanzionatorio. Inoltre, la rivoluzione digitale porta sempre più l'integrazione tra l’uomo e la macchina, richiedendo un’analisi della qualificazione dei nuovi sistemi informatici che si inseriscono nel rapporto di lavoro.

Today's technology brings with it problems that are also reflected in the world of work. The use of social networks, big data and more generally new technologies compromise the figure of the worker who, as a weak part of the employment relationship, requires growing protection in the wake of technological progress. Not only the Workers' Statute, but also the legislation on privacy, recognize rights to workers, as natural persons, guaranteeing fundamental principles and rules in the employment relationship: from the analysis of the prohibition of investigations, to the regulation of the power of remote control, the matter of confidentiality is intertwined, as is the related sanctioning system. Furthermore, the digital revolution increasingly brings integration between man and machine, requiring an analysis of the qualification of the new IT systems that are inserted into the employment relationship.
