Cambiamenti Climatici nel Diritto Internazionale: Prospettive di Evoluzione

Abstract

L’elaborato affronta il tema dei cambiamenti climatici nel diritto internazionale. Lo scopo è quello di fornire un’analisi dei principali strumenti facenti parte del diritto internazionale e valutarne l’efficacia. Nel primo capitolo vengono analizzati i trattati e i principi fondamentali di diritto internazionale nell’ambito dei cambiamenti climatici chiudendo infine con un tema che sarà oggetto del secondo capitolo, il rapporto tra i diritti umani e il cambiamento climatico. Nel secondo capitolo viene portato all’analisi un famoso caso promosso dalla Fondazione Urgenda contro i Paesi Bassi e vengono commentate le sentenze delle Corti che si sono espresse. La tesi termina con delle brevi considerazioni conclusive riguardo l’efficenza effettiva del diritto internazionale in materia di cambiamenti climatici e la risonanza che il caso Urgenda ha avuto in tutto il mondo.

The thesis addresses the topic of climate change in international law. The main purpose is to provide an analysis of the main instruments forming parts of international law and to rate the efficiency. The first chapter analyzes the treaties and the foundamental principles of international law on climate change, finally closing with a topic that will be the subject of the second chapter. The second chapter analyzes a famous case promoted by Urgenda Foundation against the Netherlands and the sentences of the Courts are discussed. The thesis ends with briefs conclusive considerations regarding the effectivness of intrnational law on climate change and the resonance that Urgenda have had throughout the world.
