Abstract

Il ricongiungimento familiare è l’istituto mediante il quale si consente a una persona di essere raggiunta dai membri della propria famiglia nel territorio di uno Stato diverso da quello d’appartenenza. La tematica dei ricongiungimenti familiari costituisce un aspetto centrale nell’ambito delle dinamiche migratorie globali, riflette la complessità delle interazioni tra gli individui, società e istituzioni. Questa tesi si articola in due capitoli: la prima parte si concentra sulla spiegazione di definizioni e nozioni giuridiche fondamentali relative all’istituto del ricongiungimento familiare. Lo scopo di questo capitolo è di fornire una solida base concettuale che possa facilitare la comprensione più approfondita della tematica affrontata nella seconda parte. Il primo capitolo parte dalla definizione base di ricongiungimento familiare per arrivare poi ad esplorare quelle che sono le leggi, regolamenti e direttive che lo disciplinano, delineando anche i requisiti e procedure che i richiedenti devono affrontare per poter ricongiungersi nei modi previsti dalle norme vigenti con i propri familiari. Nella seconda parte, la tesi si sposta verso un’analisi più esaustiva concentrandosi su una sentenza specifica. L’obbiettivo è quello di sviscerare il caso fornendo un’esplorazione dettagliata degli argomenti centrali e dei tratti più significativi, evidenziando le procedure e le ragioni che l’hanno resa controversa e il diritto delle persone di condurre una vita familiare unificata. La seguente tesi analizza l’ambito dei ricongiungimenti familiari con lo scopo di offrire una visione più completa dell’istituto, cercando di mettere in evidenza le sue complessità tenendo conto degli aspetti ad esso connessi e delle eventuali implicazioni.

Family reunification is the institution through which an individual is allowed to be joined by members of their family in an area of a State other than the one to which they belong. The issue of family reunification is a central aspect in the context of global migratory dynamics, reflecting the complexity of interactions between individuals, societies, and institutions. This thesis is divided into two chapters: the first part focuses on the explanation of relevant definitions and fundamental legal notions related to the institution of family reunification. The purpose of this chapter is to provide a solid conceptual foundation that can facilitate a more in-depth understanding and analysis of the topic addressed in the second part. The first chapter starts with the basic definition of family reunification and then explores the laws, regulations, and directives that govern it. It also outlines the requirements and procedures that applicants must face in order to be reunited with their family members in accordance with the rules in force. In the second part, the thesis moves towards a more exhaustive analysis focusing on a specific aspect. The goal is to dissect the case by providing a detailed exploration of the central topics and the most significant traits, while highlighting the procedures and reasons that render it controversial, as well as the right of people to lead a unified family life.The following thesis analyzes the field of family reunification with the aim of offering a more complete vision of the institution, attempting to highlight its complexities by taking into account the connected aspects and any implications.
