L'Unione Europea e il mondo digitale: una lotta contro la disinformazione

Abstract

In questo elaborato, vengono analizzate le pratiche che l’Unione Europea ha messo in campo per contrastare il fenomeno della disinformazione, anche attraverso casi studio specifici ed interviste a principali attori nell’ambito della ricerca e del giornalismo. Dopo l’analisi dei disordini dell’informazione, tali fenomeni vengono accostati alle norme sui diritti fondamentali dell’uomo, tracciandone le violazioni collegate con l’ausilio di fatti di cronaca avvenuti nel mondo. Delineati i trattati internazionali firmati, in precedenza, dagli Stati Membri dell’Unione Europea, con riferimento alla “Joint Declaration on Freedom of Expression and ‘Fake News’, Disinformation and Propaganda”, viene introdotto il “Codice di Condotta sulla Disinformazione”. Successivamente, lo studio continua con possibili soluzioni normative al problema della disinformazione considerando sia norme già approvate dall’Unione Europea e dai suoi Stati Membri, che ulteriori violazioni a trattati inerenti i Diritti Fondamentali dell’Uomo. Su queste basi, vengono poi analizzate altre attività portate avanti dall’Unione Europea: l’“Action Plan Against Disinformation”, lo “European Media Freedom Act” e le iniziative per la limitazione delle SLAPPs Vengono esposte, poi, le attività di due centri di ricerca: il portale “EUvsDisinfo”, creato dall’East StratCom Task Force, e il network di EDMO – European Digital Media Observatory. Si illustrano, infine, due casi studio: il primo è dedicato al legame tra la disinformazione e la pandemia da COVID-19, con le attività e le collaborazioni messe in atto dall’Unione Europea per contrastare la diffusione dell’infodemia; il secondo tratta il caso di RT France contro il Consiglio Europeo circa l’interdizione, da parte di quest’ultimo, alle attività di trasmissione in Unione Europea delle testate affiliate a RT – Russia Today.

In this paper, the practices that the European Union has implemented to combat the phenomenon of disinformation are analyzed, also through specific case studies and interviews with main actors in the field of research and journalism. After the analysis of information disorders and their many facets, these phenomena are compared to the rules on fundamental human rights, tracing the related violations with the help of news events that have occurred in the world. Having outlined the international treaties previously signed by the Member States of the European Union, regarding the "Joint Declaration on Freedom of Expression and 'Fake News', Disinformation and Propaganda", the "Code of Practice on Disinformation" is introduced. Subsequently, the study continues with possible regulatory solutions to the problem of disinformation considering both regulations already approved by the European Union and its Member States, and further violations of treaties relating to Fundamental Human Rights. On this basis, other activities carried out by the European Union are analyzed, such as the "Action Plan Against Disinformation", the "European Media Freedom Act" and the initiative against SLAPPs. The activities of two research centres are then exposed: the "EUvsDisinfo" portal, created by the East StratCom Task Force, and the network of EDMO - European Digital Media Observatory. Finally, two case studies are illustrated: the first is dedicated to the link between disinformation and the COVID-19 pandemic, with the activities and collaborations implemented by the European Union to combat the spread of the infodemic; the second deals with the case of RT France against the European Council regarding the ban by the latter on the broadcasting activities in the European Union of broadcasters affiliated with RT - Russia Today.
