L’ARCHEOLOGIA PREVENTIVA, LA TUTELA DEL TERRITORIO IN UN’OTTICA DI SVILUPPO

Abstract

Territorial government - urban planning - preventive archaeology. The contribution delves into the theme of the relationship between the government of the territory and the protection and valorisation of the archaeological heritage as outlined by the state/regional legislator and by jurisprudence. In particular, the profiles of the strengthened relationship between urban planning and archaeological territorial analysis are examined from the perspective of public and preventive archaeology: To better illustrate the current regulatory and operational situation, we focused on the relationship between the government of the territory and public archeology also in light of a recent regulatory intervention on the subject by the Sicilian Region which could constitute a useful reference for the extension from preventive/predictive archeology to urban planning and construction, introducing an innovative element aimed at strengthening the much desired connection between the power of urban planning regulation (divided between the regional and municipal levels) and that attributed to the superintendencies in matters of archaeological protection , entrusting - among other things - the urban plan with the task of strengthening its attractive capacity for civic and tourist use with the related provisions for services, commercial activities and hospitality etc. and the unavoidable synergies with the urban fabric.

Governo del territorio - pianificazione urbanistica - archeologia preventiva. Il contributo approfondisce il tema del rapporto tra il governo del territorio e la tutela e la valorizzazione del patrimonio archeologico come delineato dal legislatore statale/regionale e dalla giurisprudenza. In particolare, vengono esaminati i profili del rapporto rafforzato tra pianificazione ur­banistica ed analisi territoriale archeologica nella prospettiva dell’archeologia pubblica e preventiva: Per meglio illustrare l’attuale situazione normativa e operativa, ci si è concentrati sul rapporto tra il governo del territorio e l’archeologia pubblica anche alla luce di un recente intervento normativo in materia della Regione Siciliana che potrebbe costituire un utile riferimento per l’estensione dell’archeologia preventiva/predittiva all’urbanistica e dall’edilizia, introducendo un elemento innovativo volto a rafforzare la tanto auspicata connessione tra il potere di regolazione urbanistica (ripartito tra il livello regionale e comunale) e quello attribuito alle soprintendenze in materia di tutela archeologica, affidando -tra l’altro- al piano urbanistico il compito di rafforzarne la capacità attrattiva per la fruizione civica e turistica con le connesse previsioni per servizi, attività commerciali ed ospitalità etc. e le ineludibili sinergie con il tessuto urbano.
