La messa alla prova minorile e ordinaria, con particolare riferimento al ruolo dei Servizi sociali (U.S.S.M. e U.E.P.E.)

Abstract

L’obiettivo di questo elaborato è di analizzare scrupolosamente gli aspetti dell’istituto della sospensione del processo con messa alla prova, sia in ambito minorile che ordinario, mantenendo il focus sul ruolo che svolge il Servizio sociale all’interno di esso. Si esamina innanzitutto l’origine e la ratio di tale probation, per poi approfondirne il funzionamento in ogni singola fase. Successivamente si osservano le competenze e le attività che gli Uffici dei Servizi Sociali Minorili e di Esecuzione Penale Esterna sono chiamati a svolgere. Il seguente lavoro è stato elaborato per verificare se l’istituto in questione è realmente utile per la difesa sociale e la deflazione giudiziaria.

The aim of this paper is to scrupulously analyze the aspects of the institution of probation, both in the juvenile and ordinary spheres, while keeping the focus on the role that Social Service plays within it. The origin and rationale of such probation is first examined, and then its operation at each stage is explored in depth. Next, the competencies and activities that the Offices of Juvenile Social Services and External Criminal Execution are called upon to perform are observed. The following paper was prepared to see whether the institution in question is really useful for social defense and judicial deflation.
