I processi di PMA e GPA nei casi di famiglie omogenitoriali e coppie eterosessuali, con distinzione tra Italia e Francia.

Abstract

Questa tesi si propone di esaminare attentamente le differenze all'interno dei processi di PMA e GPA, concentrandosi sul contesto della relazione tra due nazioni europee, l'Italia e la Francia. In entrambi questi paesi, la PMA e la GPA sono state soggette a cambiamenti legislativi e culturali nel corso degli anni, ma il modo in cui queste pratiche sono accettate, gestite, e regolamentate varia notevolmente tra le due nazioni. Attraverso un'analisi dettagliata delle leggi, delle politiche sanitarie e delle pratiche cliniche in Italia e in Francia, questa tesi intende gettare luce sulle similitudini e le divergenze che definiscono l'approccio a tali tematiche in questi due contesti nazionali confinanti, ma con importanti differenze nell’affrontare le questioni etiche e sociali. Mi soffermerò su due diversi tipi di famiglie coppie eterosessuali e famiglie omogenitoriali soffermandomi sulla loro composizione e sulle sfide che devono affrontare per permettere l’evoluzione della propria famiglia.

This thesis aims to carefully examine the differences within the processes of ART (Assisted Reproductive Technologies) and surrogacy, focusing on the context of the relationship between two European nations, Italy and France. In both of these countries, ART and surrogacy have undergone legislative and cultural changes over the years, but the way these practices are accepted, managed, and regulated varies significantly between the two nations. Through a detailed analysis of laws, healthcare policies, and clinical practices in Italy and France, this thesis intends to shed light on the similarities and differences that define the approach to these issues in these two neighboring national contexts, which have significant variations in addressing ethical and social issues. I will focus on two different types of families, heterosexual couples, and same-sex parent families, examining their composition and the challenges they face in order to facilitate the evolution of their family structures.
