"I am a woman but not a female": le condizioni di vita dell'individuo transgender nelle strutture carcerarie

Abstract

Il presente lavoro di tesi ha come obiettivo quello di trattare il tema delle condizioni di vita degli individui transgender nelle carceri italiane. Si tratta di un argomento poco conosciuto nel nostro Paese e che per questo necessita di approfondimenti, volti a comprendere come vengono accolti i bisogni di queste persone e che cosa può essere fatto in futuro in questa direzione. Uno dei principali problemi che deve essere affrontato quando il detenuto è transgender è il suo collocamento all’interno delle sezioni del carcere: le persone transgender MtF (Male To Female), per esempio, che psicologicamente adottano il genere femminile ma che appartengono biologicamente al sesso maschile, sono destinate a scontare la propria pena in sezioni maschili, andando incontro a problematiche di vario tipo. Segue il problema della violenza dietro le sbarre: il fatto di condividere la cella o la sezione con detenuti transgender è fonte di disagio per gli altri reclusi e non raramente anche per gli operatori penitenziari. Questa situazione può dare origine a episodi di aggressione, fisica e/o verbale. Un’ulteriore difficoltà è rappresentata dalla assunzione della terapia ormonale, necessaria sia a chi ha compiuto l’operazione del cambio di sesso sia a chi non l’ha affrontata, che non raramente viene negata. Inoltre, anche all’esterno del carcere la condizione della persona transgender è caratterizzata da reazioni negative della società, che spesso denigra ed emargina chi percepisce come “diverso”. È pur vero che nel tempo molti sono stati i cambiamenti positivi nel modo di vedere e di trattare le soggettività transgender e transessuali, a partire dalla definizione diagnostica iniziale di “disturbo” per arrivare al concetto di “disforia di genere”, fino all’ottenimento di alcuni diritti e tutele. Nonostante ciò, permangono alcuni ostacoli che richiedono di essere superati.

The purpose of this thesis is to discuss the living conditions of trans people in Italian prisons. The aim of this thesis is to deal with the living conditions of transgender individuals in Italian prisons. This is a topic that is little known in our country and that for this needs further study, aimed at understanding how the needs of these people are met and what can be done in the future in this direction. One of the main issues that needs to be addressed when the prisoner is transgender is his placement within the prison sections: transgender people MtF (Male To Female), for example, who psychologically adopt the female gender but who belong biologically to the male sex, are destined to serve their sentences in male sections, meeting problems of various kinds. It follows the problem of violence behind bars: sharing the cell or section with transgender inmates is a source of discomfort for other inmates and not infrequently also for prison workers. This situation can give rise to episodes of aggression, physical and/ or verbal. A further difficulty is represented by the intake of hormonal therapy, necessary both to those who have performed the operation of the change of sex and to those who have not faced it, which is not rarely denied. In addition, even outside prison the condition of the transgender person is characterized by negative reactions of society, which often denigrates and marginalizes those who perceive as "different". It is true that over time there have been many positive changes in the way of seeing and treating transgender and transsexual subjectivities, starting from the initial diagnostic definition of "disorder" to arrive at the concept of "gender dysphoria"until certain rights and safeguards are obtained. Nevertheless, there are still some obstacles that need to be overcome.
