La tutela della privacy e la garanzia del segreto nella codificazione canonica. Spunti di riflessione in prospettiva comparatistica

Abstract

Lo scopo di questa tesi è di mettere in luce le problematiche legate alla tutela della privacy e la garanzia del segreto nella codificazione canonica, in una prospettiva comparatistica tra diritto dell' Unione Europea e Legislazione Italiana. Nel primo capitolo affronto la problematica della tutela della privacy nell' ordinamento canonico andando a trattare argomenti come il diritto alla buona fama e la creazione di banche dati digitale e le problematiche che quest' ultime hanno comportato. Nel secondo capitolo tratterò il concetto di segreto nel diritto canonico, mentre nel terzo evidenzierò le forme di tutela che la Chiesa ha riservato ai suoi fedeli in materia di riservatezza. Infine concludo il mio elaborato parlando dei rapporti che si sono venuti a creare tra Stato della Chiesa e Unione Europea e come questi oggi coesistere e operino insieme.

The purpose of this thesis is to highlight the issues related to the protection of privacy and the guarantee of secrecy in canonical codification, in a comparative perspective between European Union law and Italian legislation. In the first chapter I deal with the problem of privacy protection in the canonical order going to deal with topics such as the right to a good reputation and the creation of digital databases and the problems that the latter have involved. In the second chapter I will deal with the concept of secrecy in canon law, while in the third I will highlight the forms of protection that the Church has reserved for its faithful in matters of confidentiality. Finally, I conclude my paper by speaking of the relationships that have arisen between the State of the Church and the European Union and how these coexist and operate together today.
