Tutela del minore nelle separazioni conflittuali e il ruolo dell'Assistente Sociale

Abstract

All’interno del primo capitolo è stato analizzato l’inquadramento giuridico della tutela del minore finalizzato a dare un quadro delle norme che regolano e hanno portato alla nascita e all’evoluzione del diritto minorile. Il secondo capitolo, invece, è stato centrato su due aspetti: sugli organi con cui collabora l’assistente sociale, nella quale sono stati analizzati nello specifico i compiti e le competenze che vengono svolte all’interno del Tribunale Ordinario, la sua distinzione dal Tribunale per i Minorenni e le mansioni specifiche della Procura della Repubblica presso il Tribunale per i Minorenni; e sulla rete dei servizi, in cui sono stati presentati i diversi istituti che giornalmente collaborano congiuntamente rispetto alla tutela e serenità del minore, ma anche riguardo al continuo conflitto tra le coppie genitoriali. E’ stato, inoltre, presentato anche il ruolo che svolgono gli avvocati all’interno dei procedimenti di separazione e divorzio e la loro collaborazione con gli assistenti sociali del servizio. Nel terzo capitolo sono state illustrate le caratteristiche delle differenti famiglie conflittuali in cui è stata analizzata la prevalenza dell’asse coniugale su quello genitoriale ed è stato specificato il ruolo dell’assistente sociale che permette a queste famiglie di trovare una nuova dimensione familiare attraverso un esercizio congiunto delle responsabilità genitoriali. Sono state poi analizzate le molteplici conseguenze, che le separazioni conflittuali, fanno ricadere sui figli ed esaminate le specificità dei mandati del Giudice rispetto ad ogni famiglia. Infine, nel capitolo conclusivo, si è cercato di dettagliare la prassi e gli aspetti metodologici che attuano i servizi socio-sanitari nel momento in cui avviene la presa in carico di tali famiglie conflittuali e sono stati elencati i professionisti coinvolti e le modalità di lavoro integrate che si attuano in queste determinate situazioni.

In the first chapter, the legal framework of the protection of minors was analyzed in order to give a framework of the rules that regulate and led to the birth and evolution of juvenile law. The second chapter, on the other hand, was centered on two aspects: on the bodies with which the social worker collaborates, in which the tasks and responsibilities that are carried out within the Ordinary Court were specifically analysed, its distinction from the for minors and the specific tasks of the Public Prosecutor's Office at the Juvenile Court; and on the network of services, in which the various institutes were presented which collaborate daily with respect to the protection and serenity of the minor, but also with regard to the continuous conflict between parental couples. The role that lawyers play in separation and divorce proceedings and their collaboration with the social workers of the service was also presented. The third chapter illustrated the characteristics of the different families in conflict in which the prevalence of the marital axis over the parental axis was analyzed and the role of the social worker was specified, which allows these families to find a new family dimension through an exercise joint parental responsibilities. The multiple consequences that conflictual separations have on children were then analysed, and the specificities of the Judge's mandates with respect to each family were examined. Finally, in the final chapter, an attempt has been made to detail the practice and the methodological aspects that implement the social-health services when taking charge of such conflicted families and the professionals involved and the integrated working methods have been listed that take place in these specific situations.
