This thesis examines the evolution and application of the non-discrimination principle within the sports legal order, highlighting its complex dialogue with national, European, and international law, as well as the specific features arising from sports autonomy. The first chapter analyzes the constitutional framework (Art. 3 Italian Constitution), comparing the extensive anti-discrimination labor legislation with the more limited regulatory interventions in sports. At the EU and international levels, it traces the legal evolution from early directives to the Treaty of Lisbon and the Charter of Fundamental Rights, focusing on soft law instruments (White Paper on Sport, Green Paper, EU resolutions and opinions) and protections under the ECHR, Protocol 12, and the Universal Declaration of Human Rights. The second chapter investigates how this principle is implemented within the sources of lex sportiva. It explores the IOC Olympic Charter and Code of Ethics, CONI regulations (Statute and Code of Sports Conduct), and the FIGC framework. Specific attention is dedicated to federal regulations, the evolution of the Code of Sports Justice, and the strict liability (responsabilità oggettiva) of sports clubs for discriminatory conduct by their members and supporters. Finally, the third chapter addresses the ongoing relevance of discrimination in sports through the analysis of high-profile media cases, such as the Di Canio and Acerbi–Juan Jesus incidents. By examining the facts and sports justice rulings, the study concludes with critical reflections on the burden of proof, the effectiveness of sanctions, and the delicate balance between safeguarding an athlete’s dignity and preserving procedural guarantees within sports justice.en_UK
