Libertà religiosa e regole sportive: spunti di riflessione in chiave comparata

Abstract

La presente tesi analizza il rapporto tra libertà religiosa e regole sportive, un tema che ha assunto crescente rilevanza nelle società contemporanee caratterizzate da pluralismo culturale e religioso. L’obiettivo della ricerca è esaminare come il diritto alla libertà religiosa si confronti con le esigenze di uniformità, sicurezza e corretto svolgimento delle competizioni sportive.

Dopo aver ricostruito l’evoluzione storica e il quadro giuridico della libertà religiosa, l’elaborato approfondisce la struttura dell’ordinamento sportivo, il ruolo delle federazioni e il principio di non discriminazione, con particolare attenzione alle questioni relative ai simboli religiosi, all’abbigliamento sportivo e alle pratiche di culto degli atleti.

L’analisi si conclude con l’esame di alcuni casi concreti che evidenziano le diverse modalità attraverso cui fede religiosa e attività sportiva possono entrare in relazione. La ricerca mostra come il rapporto tra sport e religione richieda un costante bilanciamento tra autonomia dell’ordinamento sportivo e tutela dei diritti fondamentali della persona.

This thesis examines the relationship between freedom of religion and sports regulations, a topic that has gained increasing importance in contemporary societies characterized by cultural and religious pluralism. The aim of the research is to analyse how the right to freedom of religion interacts with the requirements of uniformity, safety and the proper conduct of sporting competitions.

After reconstructing the historical development and legal framework of religious freedom, the study explores the structure of the sports legal system, the role of sports federations and the principle of non-discrimination, with particular attention to issues concerning religious symbols, sportswear and religious practices of athletes.

The analysis concludes with the examination of several case studies that highlight the different ways in which religious faith and sporting activity may interact. The research shows that the relationship between sport and religion requires a constant balance between the autonomy of sports organisations and the protection of fundamental human rights.
