Recenti iniziative dell'UE in materia di immigrazione: il caso del riconoscimento facciale in Eurodac

Abstract

Il presente elaborato si pone l’obiettivo di esaminare le novità introdotte nel sistema Eurodac con il Nuovo Patto sulla migrazione e l’asilo. Nello specifico, si vuole valutare il possibile utilizzo di tecnologie di riconoscimento facciale, richiamato dagli artt. 57 e 63 del Regolamento (UE) 2024/1358. Partendo dall’analisi del diritto primario rilevante in materia, si passerà a comprendere come la progressiva tecnologizzazione delle frontiere abbia condotto l’Unione verso questa soluzione. L’attenzione si concentrerà poi sulle condizioni poste dall’AI Act e sulla compatibilità del riconoscimento facciale con i diritti fondamentali garantiti dalla Carta dei diritti fondamentali dell’Unione europea e dalla Convenzione Europea dei Diritti dell’Uomo.

This thesis aims to examine the innovations introduced to the Eurodac system by the New Pact on Migration and Asylum. In particular, it focuses on the potential use of facial recognition technologies, as provided for in Articles 57 and 63 of Regulation (EU) 2024/1358. Starting from an analysis of the relevant primary law, the thesis explores how the progressive technologisation of border management has led the European Union towards the adoption of this solution. It then focuses on the conditions laid down by the AI Act and on the compatibility of facial recognition technologies with the fundamental rights guaranteed by the Charter of Fundamental Rights of the European Union and the European Convention on Human Rights.
