La Tutela del Consumatore nel Diritto Internazionale privato dell’Ue: il punto sulla più recente giurisprudenza della Corte di Giustizia.

Abstract

La tesi tratta la tutela del consumatore nel diritto internazionale privato dell'UE. Nel primo capitolo viene ricostruito il percorso storico-normativo: si parte dai Trattati, si analizzano le prime direttive e si arriva ai regolamenti sulla giurisdizione e legge applicabile, fino alle più recenti riforme indotte dall'avvento delle tecnologie digitali. Il secondo capitolo si concentra sui due pilastri del diritto internazionale privato: il regolamento (UE) n.1215/2012 (Bruxelles I bis) e il regolamento (CE) n.593/2008 (Roma I). Si analizzano le disposizioni generali per poi soffermarsi su quelle dedicate alla tutela del consumatore. Il terzo capitolo analizza due recenti pronunce della Corte di giustizia dell'Unione europea che interpretano tali disposizioni in casi riguardanti contratti con consumatori.

he thesis deals with consumer protection in EU private international law. In the first chapter, the historical-normative path is reconstructed: it starts from the Treaties, analyzes the first directives and arrives at the regulations on jurisdiction and applicable law, up to the most recent reforms induced by the advent of digital technologies. The second chapter focuses on the two pillars of private international law: Regulation (EU) 1215/2012 (Brussels I bis) and Regulation (EC) 593/2008 (Rome I). The general provisions are analysed, followed by those relating to consumer protection. The third chapter analyses two recent rulings of the Court of Justice of the European Union interpreting these provisions in cases involving consumer contracts.
