Il diritto dei trasporti dell'Unione Europea: la disciplina portuale

Abstract

La tesi analizza il quadro normativo dell’Unione europea in materia di trasporti e porti, con particolare attenzione alla progressiva armonizzazione delle discipline e ai principi fondanti alla base della regolamentazione. Dopo una panoramica sull'evoluzione e le sfide della politica comune dei trasporti, il lavoro sottolinea e argomenta il crescente ruolo strategico dei porti nell’economia europea, evidenziando il progressivo percorso verso l’adozione di un quadro normativo comunitario. Un’attenzione particolare è dedicata al Regolamento (UE) 2017/352, che ha introdotto regole comuni per garantire maggiore trasparenza finanziaria e condizioni di concorrenza equilibrate nel settore portuale. L’analisi si sofferma sul delicato equilibrio tra l’apertura al mercato e la tutela degli interessi strategici nazionali, considerando anche il ruolo degli investimenti europei nello sviluppo delle infrastrutture portuali. La tesi si sofferma poi anche sull'interpretazione italiana delle norme europee, prendendo in analisi la legge 84/1994 e la successiva riforma del 2016 che istituisce le Autorità di Sistema Portuale. Infine, dopo aver delineato la normativa attuale, la ricerca evidenzia le principali sfide future per il settore, tra cui la digitalizzazione, la transizione ecologica e la necessità di un maggiore coordinamento tra gli Stati membri per ridurre le disomogeneità ancora esistenti.

The thesis examines the European Union's regulatory framework on transport and ports, with particular attention to the progressive harmonization of legislation and the founding principles underlying regulation. After an overview of the evolution and challenges of the common transport policy, the study highlights and discusses the growing strategic role of ports in the European economy, emphasizing the gradual move towards the adoption of a common regulatory framework. Particular attention is given to Regulation (EU) 2017/352, which introduced common rules to ensure greater financial transparency and balanced competition conditions in the port sector. The analysis focuses on the delicate balance between market liberalization and the protection of national strategic interests, also considering the role of European investments in port infrastructure development. The thesis further examines the Italian interpretation of EU regulations, analyzing Law 84/1994 and the subsequent 2016 reform establishing the Port System Authorities. Finally, after outlining the current regulatory framework, the research highlights the main future challenges for the sector, including digitalization, ecological transition, and the need for greater coordination among Member States to reduce the persisting regulatory disparities.
