Ricongiungimento familiare con cittadini extra UE nella direttiva 2003/86

Abstract

Il presente elaborato ha ad oggetto l’istituto del ricongiungimento familiare. In particolare, è presente un approfondimento della direttiva 2003/86/CE, dedicata al ricongiungimento familiare spettante ai cittadini provenienti da Paesi terzi. La tesi è strutturata in tre capitoli: Nel primo, è possibile trovare un approfondimento del concetto di “cittadinanza europea” e del diritto al ricongiungimento familiare nel contesto europeo, sulla base della direttiva 2004/38/CE applicabile ai cittadini UE; Nel secondo capitolo, si trova un’analisi approfondita relativamente alla direttiva 2003/86/CE, che regola il ricongiungimento con cittadini di paesi terzi, anche alla luce della Convenzione Europea per i Diritti dell’Uomo e del suo art. 8, dal momento che è lo stesso considerando 2 della direttiva 2003/86, a sottolineare che le misure adottate in materia di ricongiungimento devono garantire il rispetto e la tutela della vita privata e familiare; L’ultimo capitolo è dedicato all’analisi di una sentenza riguardante il rigetto di una domanda di ingresso e soggiorno al fine del ricongiungimento familiare. Tale rifiuto, da parte dell’Ufficio Stranieri dello stato del Belgio, ha fatto sì che il giudice del rinvio sottoponesse la questione alla Corte mediante un Procedimento Pregiudiziale Urgente.

This thesis focuses on the institution of family reunification. Specifically, it provides an in-depth analysis of Directive 2003/86/EC, which addresses family reunification rights for citizens from third countries. The thesis is structured into three chapters: The first chapter delves into the concept of “European citizenship” and the right to family reunification in the European context, based on Directive 2004/38/EC, which applies to EU citizens; The second chapter provides a detailed analysis of Directive 2003/86/EC, which regulates reunification with third-country nationals. This analysis also considers the European Convention on Human Rights (ECHR) and its Article 8, as recital 2 of Directive 2003/86/EC emphasizes that measures on family reunification must ensure respect for and protection of private and family life; The final chapter is dedicated to the analysis of a judgment concerning the rejection of an application for entry and residence for family reunification purposes. This refusal, issued by the Foreigners' Office of the Belgian state, led the referring judge to submit the matter to the Court through an Urgent Preliminary Ruling Procedure.
