This thesis examines the witness statements given by particularly vulnerable victims during the preliminary investigation stage, with reference to the protected interviewing procedures regulated by Articles 351 and 362 of the Italian Code of Criminal Procedure.
The research develops along three complementary lines of inquiry, corresponding to the three chapters of the thesis. The first one traces the historical and legal development of the protection afforded to victims, focusing on the gradual emergence of a specific regulatory framework governing witness statements, considering the principal national, supranational and international legislative measures. The second examines the current legal framework, focusing on all the elements that characterise this special form of interviewing. The third considers the practical application of these rules through the analysis of judicial practice, based on documentation produced by Public Prosecutors’ Offices, law enforcement agencies and agencies involved in any way in the protection of victims.
Considering this analysis, witness statements may be regarded as one of the most significant expressions of the legal system’s growing attention to the protection needs of the victims in conditions of particular vulnerability. Their examination makes it possible to trace the evolution of victim protection not only at the normative level, but also in terms of its practical implementation.
