Abstract

This thesis deals with the abuse of law in the field of taxation, a topic of great importance both in European law and in the Italian legal system. The fundamental principles of tax law are first analysed, starting from general concepts, such as the ability to pay principle, and moving on to the principles that characterise the tax relationship. The first chapter ends with a distinction between the concept of abuse of law and other similar concepts, such as tax avoidance, tax evasion and legitimate tax saving. The thesis then examines the development of this concept within the Italian legal system, from the initial lack of specific legislation to the current provisions. The core of the thesis is found in the third chapter which focuses on the analysis of the concept of abuse of law, with particular attention to the judgment of the Court of Justice of the European Union in the Cadbury Schweppes case (C-196/04).The judgment is examined in its different stages from the presentation of the arguments put forward by the parties to the analysis of the Court's reasoning. The thesis examines the compatibility of the UK rules on CFCs with the freedom of establishment guaranteed by Article 49 TFUE. Represents a step in the development of the concept of abuse of law, as it makes it possible to identify the specific elements whose presence or absence is essential in determining whether a situation can be considered abusive or not. Among these elements, particular importance is given to the concept of a "wholly artificial arrangement", which was later taken up in subsequent case law.The fourth chapter concludes with an analysis of the procedural aspects and the main critical issues. In relation to the procedural aspects, particular attention is paid to the principle of the right to be heard, the burden of proof and the system of sanctions. It concludes by examining the coordination between Italian legislation and ATAD Directive, which was introduced to combat abusive tax arrangements.
