Abstract
Il presente elaborato propone un'analisi comparatistica tra l'ordinamento costituzionale italiano e quello tedesco in merito al principio del ripudio della guerra, misurandone la tenuta giuridica e democratica di fronte alla crisi ucraina. Partendo dall'“ora zero” del secondo dopoguerra, si esamina le genesi parallele dell'articolo 11 della Costituzione italiana e degli articoli 24, 25 e 26 della Legge Fondamentale tedesca. Entrambi gli ordinamenti hanno eretto il pacifismo e la limitazione della sovranità a pilastri istituzionali per garantire la partecipazione a sistemi di sicurezza collettiva. Lo studio indaga poi le tensioni causate dall'invio di armamenti a Kiev a partire dal 2022. Nonostante il comune impianto costituzionale, i due Paesi hanno reagito all'emergenza con modalità diametralmente opposte. L'analisi del caso italiano evidenzia un forte squilibrio istituzionale: l'Esecutivo ha forzato il sistema normativo (in particolare la Legge 185/1990) ricorrendo alla continua decretazione d'urgenza. L'esclusione del Parlamento si è consumata attraverso la sistematica secretazione delle liste degli armamenti e il dirottamento dell'obbligo informativo verso il COPASIR, organo strutturalmente inadatto a favorire un dibattito pubblico trasparente. Al contrario, il modello tedesco ha affrontato la Zeitenwende salvaguardando la dialettica democratica e coinvolgendo il Bundestag. Il governo ha pubblicato gli elenchi delle armi e ha agito in trasparenza, arrivando a modificare la Costituzione (artt. 109 e 115) per esentare gli aiuti militari dal freno all'indebitamento In conclusione, la tesi dimostra come la rigidità formale della Costituzione italiana non sia sufficiente a tutelarne i principi supremi. Di fronte alla geopolitica, si è aggirato l'art. 11 tramite opacità ed emergenzialità, trasformando il pacifismo in una copertura formale. Ciò evidenzia un divario profondo rispetto alla maturità democratica e all'assunzione di responsabilità istituzionale tedesche.
 
This paper proposes a comparative analysis between the Italian and German constitutional systems regarding the principle of the repudiation of war, assessing their legal and democratic resilience in the face of the Ukrainian crisis. Starting from the post-WWII “zero hour”, the study examines the parallel genesis of Article 11 of the Italian Constitution and Articles 24, 25, and 26 of the German Basic Law. Both legal frameworks have established pacifism and the limitation of sovereignty as institutional pillars to guarantee participation in collective security systems. The study then investigates the tensions arising from the supply of weapons to Kyiv starting in 2022. Despite a shared constitutional foundation, the two countries reacted to the emergency in diametrically opposed ways. The analysis of the Italian case highlights a severe institutional imbalance: the Executive has forced the regulatory framework (specifically Law 185/1990) by continuously resorting to emergency decrees. The marginalization of Parliament was carried out through the systematic classification of the arms lists as state secrets and the diversion of reporting obligations to COPASIR, a body structurally unsuited to fostering a transparent public debate. Conversely, the German model addressed the Zeitenwende by safeguarding democratic dialectics and involving the Bundestag. The government published the lists of weapons and acted with transparency, even going so far as to amend the Constitution (Arts. 109 and 115) to exempt military aid from the debt brake. In conclusion, the thesis demonstrates that the formal rigidity of the Italian Constitution is insufficient to protect its supreme principles. In the face of geopolitical pressures, Article 11 was bypassed through opacity and emergency measures, transforming pacifism into a mere formal cover. This highlights a profound gap compared to the democratic maturity and the assumption of institutional responsibility shown by Germany.
