Il trasporto aereo rappresenta uno dei settori più dinamici dell’economia globale: garantisce mobilità, sostiene il turismo, facilita gli scambi commerciali, crea occupazione e connette le regioni periferiche. A tale rilevanza si accompagna un impatto ambientale significativo, pari a circa il 3% delle emissioni globali di gas a effetto serra, percentuale destinata ad aumentare con la crescita della domanda. Per rispondere a questa sfida, l’Unione europea ha adottato il Regolamento (UE) 2023/2405 (ReFuelEU Aviation), volto a creare un mercato dei carburanti sostenibili per l’aviazione attraverso un approccio regolatorio innovativo. La valutazione dell’effettività del Regolamento richiede un’analisi integrata dei profili giuridici, economici, ambientali e tecnici, considerando processi produttivi, criteri di sostenibilità, certificazione, disponibilità delle materie prime, costi e capacità industriale. L’interesse del tema risiede nella necessità di conciliare sostenibilità ambientale e sviluppo del settore, in un contesto in cui i cambiamenti climatici incidono sulla vita di tutti i giorni. La tesi si articola in tre capitoli: il primo analizza contenuto, obiettivi, ambito di applicazione, soggetti coinvolti, obblighi e sistemi di controllo del Regolamento; il secondo approfondisce interpretazione, enforcement e criticità applicative; il terzo esamina il fenomeno del tankering, valutandone effetti economici e ambientali e le misure con cui il RFEUA tenta di contrastarlo. L’analisi complessiva consente di delineare finalità, struttura ed esigenze applicative del Regolamento, evidenziando come un quadro normativo europeo certo e unitario, supportato da sistemi di controllo affidabili e da adeguati investimenti infrastrutturali, costituisca condizione essenziale per la creazione di un mercato dei carburanti sostenibili per l’aviazione coerente con gli obiettivi di lungo periodo del trasporto aereo europeo. Air transort is one of the most dynamic sectors of the global economy: it ensures mobility, supports tourism, facilitates commercial exchanges, generates employment and connects peripheral regions. Its relevance is accompanied by a significant environmental impact, accounting for around 3% of global greenhouse gas emissions, a share expected to rise as demand continues to grow. To respond to this challenge, the European Union adopted Regulation (EU) 2023/2405 (ReFuelEU Aviation), aimed at creating a market for sustainable aviation fuels through an innovative regulatory approach.
Assessing the effectiveness of the Regulation requires an integrated analysis of legal, economic, environmental and technical dimensions, including production processes, sustainability criteria, certification systems, availability of feedstocks, costs and industrial capacity. The topic is of particular interest due to the need to reconcile environmental sustainability with sectoral development, in a context where climate change increasingly affects everyday life. The thesis is structured into three chapters: the first examines the content, objectives, scope, actors involved, obligations and control mechanisms established by the Regulation; the second explores issues of interpretation, enforcement and practical implementation; the third analyses the phenomenon of fuel tankering, assessing its economic and environmental implications and the measures introduced by the RFEUA to counter it. The overall analysis outlines the aims, structure and operational requirements of Regulation (EU) 2023/2405, highlighting that a clear and harmonised European regulatory framework, supported by reliable monitoring systems and adequate infrastructure investments, is essential for the creation of a sustainable aviation fuel market capable of ensuring sufficient supply and aligning with the long-term objectives of the European air transport industry.
