La Trasformazione del Concetto di Famiglia: La Gestazione per Altri come Sfida Culturale e Sociale.

Abstract

Il presente lavoro di tesi, intitolato “La Trasformazione del Concetto di Famiglia: La Gestazione per Altri come Sfida Culturale e Sociale”, si propone di indagare la profonda metamorfosi dell’istituto familiare contemporaneo, inteso come un costrutto socioculturale in perenne evoluzione. Attraverso un’analisi interdisciplinare, l’elaborato decostruisce il tramonto del modello patriarcale tradizionale per accogliere la pluralità delle moderne “costellazioni affettive”, dove il valore del legame è dettato dalla profondità della cura e della responsabilità educativa piuttosto che dal solo vincolo di sangue. Viene esplorata la Gestazione per Altri, che scardina i paradigmi consolidati di parentela e introduce una separazione tra il processo biologico della gravidanza e la volontà genitoriale. La tesi approfondisce le tecniche di Procreazione Medicalmente Assistita e la loro capacità di dissociare la sessualità dalla riproduzione, ponendo le basi per il concetto di genitorialità intenzionale e sociale, che ponga al centro il superiore interesse del minore e riconosca la dignità di tutte le formazioni familiari nate da un progetto genitoriale consapevole. Vengono esaminate le diverse correnti del femminismo e le loro posizioni divergenti tra la denuncia dello sfruttamento e la rivendicazione dell’autodeterminazione corporea, come anche l’impatto dello stigma sociale sulla figura della gestante. Viene messo a confronto il modello Irlandese, che ha intrapreso una regolamentazione pragmatica basata sulla laicità, con il contesto italiano, caratterizzato da un recente inasprimento normativo che eleva la GPA a “reato universale”. La tesi sostiene la necessità di un superamento delle polarizzazioni ideologiche a favore di un quadro normativo organico che ponga al centro il superiore interesse del minore e riconosca la dignità di tutte le formazioni familiari nate da un progetto genitoriale consapevole.

This thesis “The Transformation of the Concept of Family: Surrogacy as a Cultural and Social Challenge,” aims to investigate the profound metamorphosis of the contemporary family institution, understood no longer as an immutable biological fact, but as a socio-cultural construct in constant evolution. Through an interdisciplinary analysis, the paper deconstructs the decline of the traditional patriarchal model to welcome the plurality of modern “affective constellations,” where the value of the bond is dictated by the depth of care and educational responsibility, rather than by the blood tie alone. The core of the research explores Gestation for Others (GPA) as a challenge that undermines consolidated kinship paradigms, introducing a separation between the biological process of pregnancy and parental will. The thesis examines Medically Assisted Procreation (MAP) techniques and their capacity to dissociate sexuality from reproduction, laying the foundations for the concept of intentional and social parenthood. Extensive space is dedicated to the theoretical debate, examining different currents of feminism (radical, intersectional, choice, and queer) and their divergent positions between the denunciation of exploitation and the claim of bodily self-determination. The impact of social stigma on the surrogate is also analyzed, deconstructing the transition from the narrative of the “gift” to that of help and care work. From a comparative perspective, the work compares the model of the Republic of Ireland, which with the Health Act 2024 has undertaken pragmatic regulation based on secularism, with the Italian context, characterized by a recent regulatory tightening that elevates GPA to a “universal crime”. In conclusion, the thesis supports the need to overcome ideological polarizations in favor of an organic regulatory framework that centers on the best interest of the child and recognizes the dignity of all family formations born from a conscious parental project.
