LA QUESTIONE DEL DIVARIO RETRIBUTIVO DI GENERE NEL DIRITTO DELL'UNIONE EUROPEA "IL FENOMENO DEL GENDER PAY GAP"

Abstract

Questo elaborato si fonda su un'attenta analisi del fenomeno del Gender Pay Gap, ossia il divario retributivo di genere, il quale si estende a molteplici contesti, nella partecipazione politica, l'istruzione, le scelte decisionali, nonché i ruoli di potere. Il fenomeno è di portata globale e richiede un’analisi che vada oltre ai singoli ordinamenti nazionali. Peraltro, esso risulta non dipendente dallo sviluppo economico di un determinato Paese, in quanto è un fenomeno trasversale. L'intento è proprio quello di soffermarsi, dapprima sul lato legislativo delle istituzioni europee, per poi orientarsi sulla disparità retributiva in Italia, dove si può percepire il patimento e la diffidenza delle giovani donne, a causa del mancato miglioramento del mercato del lavoro, rispetto ad altre realtà internazionali molto più sviluppate, e descrivendo gli impatti della normativa europea nel quadro legislativo nazionale nonché cercando di evidenziare quelle che saranno le prospettive future del Gender Pay Gap.

This paper is based on a careful analysis of the phenomenon of Gender Pay Gap, which extends to multiple contexts, in political participation, education, decision-making choices, as well as roles of power. The phenomenon is global in scope and requires an analysis that goes beyond individual national systems. Moreover, it is not dependent on the economic development of a particular country, as it is a transversal phenomenon. The intention is precisely to dwell, first on the legislative side of the European institutions, and then focus on the pay gap in Italy, where you can perceive the suffering and distrust of young women, because of the lack of improvement in the labour market, compared to other international realities much more developed, and describing the impacts of European legislation in the national legislative framework and trying to highlight what will be the future prospects of the Gender Pay Gap.
