Questo lavoro si propone di ricostruire l’evoluzione storica che ha portato alla formazione dell’attuale disciplina antielusiva, sia ripercorrendo i vari interventi legislativi antecedenti alla riforma, sia analizzando le pronunce più significative in ambito comunitario.
Ulteriore obiettivo della presente tesi è quello di andare a “scomporre” elemento per elemento la definizione di abuso del diritto indicata dall’articolo 10-bis dello Statuto dei diritti del contribuente ponendo l’accento su ogni singolo elemento costitutivo del principio.
Infine, sposteremo la nostra attenzione sul panorama internazionale e comunitario, andando a commentare sia le disposizioni dell’Unione Europea atte a combattere l’abuso del diritto, che i progetti in via di attuazione a livello internazionale, come ad esempio il progetto BEPS (Base erosion and profit shifting) dell’OCSE, l’Organizzazione per la cooperazione e lo sviluppo economico.
Ultimo tema del presente lavoro sarà quello della concorrenza fiscale tra stati ossia norme, azioni, meccanismi posti in essere dalle autorità pubbliche allo scopo di ridurre il carico fiscale di uno stato e attrarre al proprio interno capitali e imprese provenienti da giurisdizioni estere. This work aims to reconstruct the historical evolution that led to the formation of the current anti-avoidance regulation, both by retracing the various legislative interventions prior to the reform and by analyzing the most significant rulings in the community context.
A further objective of this thesis is to "break down" element by element the definition of abuse of rights indicated by Article 10-bis of the Statute of Taxpayers' Rights, placing emphasis on each individual constitutive element of the principle.
Finally, we shift our attention to the international and community panorama, commenting both on the provisions of the European Union aimed at combating the abuse of rights, and on the projects being implemented at an international level, such as the BEPS project (Base erosion and profit shifting) of the OECD, the Organization for Economic Co-operation and Development.
The last theme of this work will be that of fiscal competition between states, i.e. rules, actions and mechanisms put in place by public authorities with the aim of reducing the tax burden of a state and attracting capital and companies from foreign jurisdictions.
