La tesi avrà ad oggetto l'istituto della rescissione del giudicato, previsto dal nostro codice di procedura penale all'art. 629-bis. Si tratta di un mezzo di impugnazione straordinario, che consente di revocare una sentenza passata in giudicato, qualora il processo si sia svolto in mancanza dei presupposti previsti per procedere legittimamente in assenza, ottenendo così la possibilità di ripetere nuovamente il giudizio.
L'elaborato si suddividerà in quattro capitoli e cercherà innanzitutto di ricostruire l'excursus storico che ha portato ad introdurre nell'ordinamento la rescissione del giudicato per mezzo della legge n. 67/2014, per passare poi ad un'analisi sia sistematica, sia processuale, dell'istituto in esame, per finire con una trattazione delle modifiche apportate dalla "Riforma Cartabia" in tema di giudizio in assenza e dei mezzi restitutori previsti dal codice.
L'obbiettivo dell'elaborato è quello di esaminare tutti gli aspetti processuali dell'art. 629-bis, a partire dallo studio approfondito dei presupposti che consentono di ottenere l'accoglimento della richiesta e degli effetti che derivano dalla rescissione della sentenza impugnata. Si evidenzieranno le criticità della disposizione indicate dalla dottrina e si riporteranno i principi di diritto espressi dalla Corte di cassazione nelle principali sentenze emesse sul tema. The thesis focusses on the rescission of final judgment, as set out in Article 629-bis of the Italian Code of Criminal Procedure. It is a special means of appeal that has the ability to rescind a final judgment and therefore repeat the trial. The rescission can be obtained if the trial took place without the conditions to lawfully proceed in the absence of the accused.
The thesis is divided into four chapters. Firstly, it traces the historical overview that led to the introduction, with the Law 67/2014 of the Code, of the rescission of final judgment. Secondly, a systematic analysis of the rescission of judgment and of its procedural aspects will be made. Lastly, it will focus on the amendments made by the Cartabia Reform regarding proceedings in the absence of the accused.
The thesis aims to examine all of the procedural aspects of Article 629-bis, starting with the in-depth analysis of the requirements allowing for the application for rescission to be accepted and the consequences deriving from the rescission of the contested judgment. This work will also highlight the critical aspects of the Article, as identified by jurists, and will illustrate the principles of law as expressed by the Court of Cassation in the leading judgments on the subject.
