LA PROVA TESTIMONIALE NEL PROCESSO TRIBUTARIO ITALIANO: ESPERIENZE EUROPEE A CONFRONTO

Il presente elaborato, è stato realizzato con il fine di analizzare l’evoluzione della prova testimoniale nel processo tributario italiano.
Il primo capitolo è incentrato sul tema del “giusto processo” che trova la sua base costituzionale nell’art. 111 della Costituzione, il quale designa un procedimento svolto nel contraddittorio delle parti, in condizioni di parità dinnanzi ad un giudice terzo ed imparziale. Principi ai quali anche il processo tributario deve uniformarsi. Di fatto però, il previgente art. 7 del D. Lgs. 546/1992 escludeva espressamente l’uso della prova testimoniale e del giuramento al processo tributario in virtù del suo carattere essenzialmente documentale.
Il secondo capitolo è incentrato sul sistema delle prove nel processo tributario, in particolare il divieto di prova testimoniale ante modifiche e le novità apportate dalla legge n. 130/2022 che ha ammesso l’uso della prova testimoniale in presenza di specifici presupposti.
Nel terzo ed ultimo capitolo viene analizzato il contenzioso tributario nell’esperienza tedesca e nell’esperienza francese. In particolare, vengono analizzati gli elementi che identificano la nozione di giusto processo nei due sistemi. I quali si caratterizzano per l’esistenza di una fase pregiudiziale obbligatoria dinanzi alla stessa amministrazione finanziaria che ha emesso l’atto. Sia in Francia che in Germania la prova testimoniale è uno degli strumenti probatori utilizzati. The present work, has been realized with the aim of analysing the evolution of the testimonial test in the Italian tax process. The first chapter focuses on the theme of “due process” which finds its constitutional basis in the article 111 of the Constitution, designates a procedure which takes place in the cross-examination of the parties, on an equal footing before an indipendent and impartial judge. Principles to which the tax trial must also conform. However, the previous article 7 of the Legislative Decree 546/1992 expressly excluded the use of witness evidence and oath to the tax process by virtue of its essentially documentary character.
Its second chapter focuses on the system of evidences in the tax process, in particular on the prohibition of witness evidence before the amendments and the novelties introduced by the law n. 130/2022 that has admitted the use of testimonial evidence without the presence of specific assumptions.
In the third and last chapter is analyzed the tax litigation in the German and French experience. In particular, the elements identifying the notion of fair process in the two systems are analysed. Both are characterized by the existence of a compulsory pre-judicial phases before the same financial administration that issued the document. Both in France and in Germany witness evidence is one of the evidentiary tools used.
