LA FISCALITA NEL PROCESSO DI INTEGRAZIONE EUROPEA

Abstract

L'elaborato prende in considerazione il potere in materia fiscale da parte dell'Unione Europea e il possibile sviluppo di una sovranità tributaria nel processo di integrazione. Partendo da una prospettiva storica, dai Trattati di Roma fino ai più recenti accordi, la tesi vuole analizzare la persistente dicotomia tra il potere fiscale in mano agli Stati e le iniziative di armonizzazione a livello comunitario. Sono state analizzate le pronunce delle Corti europee che hanno cercato di allargare la portata applicativa dei Trattati e infine ci è posti nella prospettiva internazionale della concorrenza fiscale e degli strumenti creati per arginare l'evasione e l'elusione.

The paper takes into consideration the tax power of the European Union and the possible development of a tax sovereignty in the integration process. Starting from a historical perspective, from the Treaties of Rome to the most recent agreements, the thesis aims to analyse the persistent dichotomy between fiscal power in the hands of the States and harmonization initiatives at Community level. The pronouncements of the European Courts which have sought to broaden the scope of application of the Treaties were analysed and finally placed in the international perspective of tax competition and the instruments created to curb evasion and avoidance.
