Cultural Heritage & Cultural Property: analisi e definizione all'interno del Codice dei Beni Culturali e del Paesaggio in relazione alle Convenzioni internazionali

Abstract

I termini cultural property & cultural heritage non sono due definizioni interscambiabili e denotano concetti radicalmente diversi. Essendo il diritto un linguaggio, un sistema linguistico, si fonda sui principi generali della logica. Il primo dei principi del diritto è quello d’identità e non contraddizione, per il quale ogni concetto o termine deve avere un significato univoco, costante per ogni sua occorrenza nel sistema. Se questa chiarezza viene a mancare e le parole diventano ambigue o cambiano di significato, sorge un disordine concettuale che può provocare incertezza, errori o addirittura la mancata applicazione di una legge.

Questa tesi esplora l’intersezione dei due termini con il Codice dei beni culturali italiano, analizzandone l’origine, lo sviluppo e la loro traduzione, in relazione alle tre convenzioni internazionali che più hanno contribuito alla loro evoluzione nello scenario internazionale.

Dopo aver illustrato l’excursus giuridico dell’attuale codice dei beni culturali e del paesaggio ed aver presentato le sue definizioni di bene e patrimonio culturale, vengono esposti l’ordinamento inglese con le proprie regole, definizioni ed enti principali circa la tutela dei beni ed il patrimonio culturale.

La tesi mira ad analizzare come i termini cultural property & cultural heritage sono tradotti e traslati all’interno del sistema codicistico, in relazione alla Convenzione dell’Aja (1954), alla Convenzione Unesco per la salvaguardia del patrimonio culturale immateriale (2003) e alla Convenzione di Faro (2005).

The terms cultural property and cultural heritage are not interchangeable, but rather refer to two fundamentally different concepts. Since law is a language - a linguistic system – it is grounded in the general principles of logic. Chief among these principles is that of identity and non-contradiction, which requires that every concept or term must have a univocal meaning, consistent in each of its occurrences within the system. If this clarity is lacking, words become ambiguous, or their meaning changes. Conceptual disorder then arises, potentially leading to uncertainty, misinterpretation or even failure to enforce laws.

This dissertation explores the intersection of these two concepts within the context of the Italian Cultural Heritage Code, analysing their origins, evolution and translation in relation to the three international conventions that have most significantly influenced their development on the world stage.

Following an account of the legal development of the currently enforced Italian Cultural Heritage and Landscape Code, presenting its definitions of cultural property and cultural heritage, this dissertation proceeds to describe the English legal system, outlining its rules, definitions and key institutions in relation to the protection of cultural property and cultural heritage.

The central aim of the dissertation is to analyse how the terms cultural property and cultural heritage are translated and transposed within the Italian Cultural Heritage and Landscape Code, with particular attention paid to the 1954 Hague Convention, the 2003 UNESCO Convention for the Safeguarding of Intangible Cultural Heritage and the 2005 Faro Convention.
