IL TRATTAMENTO PENITENZIARIO DEGLI AUTORI DI REATI SESSUALI: L’OSTATIVITA’ TEMPORALE E LA RICHIESTA DI “REVISIONE CRITICA”

Abstract

La presente tesi analizza il tema del trattamento penitenziario riservato agli autori di reati sessuali, con un focus specifico sull’ostatività temporale prevista dall’articolo 4-bis dell’ordinamento penitenziario e sulla necessità di una revisione critica delle condotte devianti. Scopo della ricerca è offrire una lettura critica e propositiva delle attuali soluzioni normative e pratiche, evidenziando la necessità di un bilanciamento tra esigenze di prevenzione, funzione rieducativa della pena e tutela dei diritti fondamentali.

This thesis analyzes the prison treatment of sexual offenders, with particular focus on the issue of temporal ostativity as provided by Article 4-bis of the Italian Penitentiary System and the need for a critical revision of their criminal behaviour. The aim of this research is to provide a critical and constructive analysis of both the normative solutions and the practices currently in place, emphasizing the need to balance prevention, the rehabilitative purpose of punishment, and the protection of fundamental rights.
